Definition of “cookies”

Cookies are short fragments of text (letters and/or numbers) that allow the web server to store information about the client (the browser, e.g. Internet explorer, chrome, firefox, opera…) to be reused during the same visit to the site (session cookies) or later, even after several days (persistent cookies) Cookies are stored, depending on the user’s preferences, by the individual browser on the specific device used (computer, tablet, smartphone).

Similar technologies, such as, for example, web beacons, transparent gifs and all forms of local storage introduced with html5, may be used to collect information about user behavior and use of the Services.

A cookie cannot extract other data from the user’s hard drive, transmit computer viruses or acquire e-mail addresses. Each cookie is specific to the user’s web browser. Some cookie functions may be delegated to other technologies. The term “cookies” refers to cookies and all similar technologies.

Depending on the characteristics and use of cookies, different types of cookies can be distinguished:

Technical cookies strictly necessary. These cookies are essential for the proper functioning of a website and are used to manage various services linked to the websites (such as login or access to reserved functions on the sites). The duration of cookies is strictly limited to the working session or they can be used for a longer period in order to memorize the visitor’s choices. Disabling strictly necessary cookies may affect the user experience and navigation on the website.

Profiling cookies. These are persistent cookies used to identify (anonymously or not) your preferences and improve your browsing experience. While browsing a site, the user may also receive on his terminal cookies sent by different sites or web servers (called “Third Parties”), on which may reside certain elements (such as, for example, images, maps, sounds, specific links to pages in other domains).

Purposes of the processing and purposes of the technical session cookies.

The only purpose of the technical cookies used on the site is to authenticate the computer or to control the session and to store specific technical information about the users who access the servers of the controller who manages the site. In this perspective, certain operations on the site could not be carried out without the use of cookies, which are therefore technically necessary in this case. For example, the access to possible reserved areas of the site and the activities that can be carried out there would be much more complex to carry out and less secure without the presence of cookies that allow the user to be identified and to maintain his identification during the session.

In order to achieve a correct regulation of these devices, it is necessary to distinguish them, since there are no technical characteristics that differentiate them from each other, precisely on the basis of the objectives pursued by those who use them. In fact, the legislator himself has gone in this direction, implementing the provisions contained in Directive 2009/136/EC, making it mandatory to obtain the prior informed consent of users for the installation of cookies used for purposes other than purely technical (see art. 1, paragraph 5, letter A) of Legislative Decree no. 69, which amended art. 122 of the Data Protection Act. The same European body that brings together all the privacy authorities of the various Member States (the so-called “Article 29 Working Party”) specified, among other things, in its opinion 4/2012 (wp194) entitled “Exemption from consent for the use of cookies”, that there are cookies for which it is not necessary to obtain the user’s prior and informed consent:

  1. Cookies whose data is entered by the user (session identifier), for a duration of one session or persistent cookies limited to a few hours in some cases;
  2. Authentication cookies, used for authenticated services, last for one session;
  3. User-centric security cookies, used to detect authentication abuse, for a limited persistent time;
  4. Session cookies for media players, such as “flash” player cookies, for the duration of a session;
  5. Session cookies for load balancing, lasting one session;
  6. Persistent cookies for user interface personalization, lasting one session (or a little longer);
  7. Cookies for sharing content via third-party social plug-ins, for logged-in members of a social network.

The data controller therefore informs you that only the technical cookies (such as those listed above) necessary for navigation within the site are operational on the site because they allow essential functions such as authentication, validation, management of a navigation session and fraud prevention and allow, for example: to identify whether the user has regularly accessed areas of the site that require prior authentication or validation of the user and the management of sessions relating to the various services and applications or the storage of data for secure access or control functions and fraud prevention.

In the interest of transparency, the following is a list of examples of technical cookies and specific use cases on the site:

  • cookies implanted directly in the user’s terminal (which will not be used for other purposes) such as session cookies used to “fill the basket” when booking online on the site, authentication cookies, multimedia content cookies such as flash players which do not exceed the duration of the session, personalization cookies (e.g. for the choice of the browsing language, the reminder of the user’s login and full password by typing the first few characters, etc.)

Third-party cookies.

When you visit a website, you may receive cookies from sites operated by other organizations (“third parties”) that may reside in Italy or abroad.

An example found on most websites is the presence of Youtube videos, Google bees, the use of Google maps and the use of “social plugins” for facebook, twitter, google+ and linkedin. These are parts of the visited page generated directly by these sites and integrated into the page of the host site. The most common use of social plugins is to share content on social networks to enhance the visitor’s user experience.

The presence of these plugins results in the transmission of cookies to and from all sites managed by third parties. The management of information collected by “third parties” is governed by the relevant policies to which reference should be made. For the sake of transparency and convenience, the web addresses of the various privacy statements and cookie management methods are listed below, noting that the controller is not responsible for the operation of third-party cookies on this site.

Liability for the use of third-party cookies.

In this regard, reference is made to the Privacy Guarantor’s general measure on cookies of May 8, 2014: “there are several reasons why it is not possible to put the publisher under the obligation to provide information and obtain consent for the installation of cookies on its website, even for those installed by “third parties.” In the first place, the publisher should always have the tools and the economic-legal capacity to assume the obligations of third parties and should therefore also be able to verify from time to time the correspondence between what is declared by third parties and the purposes they actually pursue with the use of cookies. This is made very difficult by the fact that the publisher often does not have direct knowledge of all the third parties that set cookies through its site, and therefore does not know the logic behind the processing in question. Moreover, it is not uncommon that between the publisher and third parties, there are entities that act as licensees, which makes it very complex for the publisher to control the activities of all entities involved. Third-party cookies could therefore be changed over time by third-party vendors, and it would be impractical to require publishers to keep track of these subsequent changes.

As stated by the privacy guarantor, this site does not have the ability to control third-party cookies if it uses third-party services (youtube, google maps, ‘social buttons’) for which the third parties are exclusively responsible. Furthermore, users are reminded that they can delete and block cookies at any time by using browser plugins and changing the settings as indicated in the various manuals contained in the browsers.

Mandatory or optional consent for the operation of cookies that do not pursue marketing purposes.

Consent is not required for the operation of only technical cookies or third-party or analytic cookies that are considered technical cookies. Their deactivation and/or refusal to function will result in the impossibility of correctly navigating the website and/or the impossibility of using the services, pages, functionalities or contents available on it.
